These General Terms & Conditions of Tesco Online shopping are set out by the company TESCO STORES SR, a.s. with the registered seat at Cesta na Senec 2, 821 04 Bratislava, ID 31321828, registered in the Commercial Register of the Bratislava I District Court, Section: Sa, File No.: 366/B, TIN: 2020301140, VAT NUMBER: SK7020000317 (hereinafter "Tesco").
These General Terms and Conditions (hereinafter "the GTC”) sets out the conditions for use of services designated as " Tesco Online Shopping " or “ Grocery Home Shopping ” (hereinafter "the Service") provided by Tesco modified on the website tesco.sk in the Tesco Online shopping section (hereinafter "the Website").
The Service lies in the presentation of Tesco goods (hereinafter "Goods") on the Website, enabling the Customer after registration and login to create a shopping list containing the goods of the Customer (hereinafter "Shopping List"), and in the delivery (and purchase) of Goods. The Goods displayed on the website does not constitute a binding offer to purchase Goods pursuant to the law of the Slovak Republic.
The Service may be used only by a natural person who has reached the age of 18, expressed consent with these GTC and duly registered on the Website (hereinafter "the Customer"). The Customer is not a legal person, natural person – entrepreneur, or a natural person under 18 years of age. Tesco reserves the right to refuse the delivery of Goods, which in view of all the circumstances was not made for a household or a natural person.
Creating a Shopping List, ordering the delivery of Goods from the Shopping List and the subsequent purchase of Goods is only possible if the Customer duly and correctly (properly) completes the registration form located on the Website where there is the necessary data for the future creation of Shopping Lists and the order of Goods delivery, i.e. the name and surname of the customer, the exact delivery address, telephone number, e-mail address (which will later be used as the username) and password, and the confirmation that the Customer is acquainted with these GTC and Privacy Policy and their acceptance of these GTC and Privacy Policy (hereinafter "Registration").
The Customer is required at registration to present only information that is timely, true, accurate and complete. After registration the Customer will create an account on the Website, through which the Customer can create Shopping Lists and order the delivery of Goods within the Services (hereinafter "Account").
A Customer who is also a member of the Tesco loyalty program called Clubcard may indicate during the Registration in the form the number of their Clubcard (cards), and in order to collect points earned on purchases and using the Clubcard in the Service. Clubcard points will be credited to the relevant account of the Clubcard customer always at the end of the calendar month in which the Goods were actually bought by the Customers. In the case of returning Goods purchased within the prescribed period, the Customer will deduct from their Clubcard account number the Clubcard points corresponding to the costs of returning the Goods.
In the event of a change of Customer data indicated during Registration on the Website, the Customer is required to update the data at the next log in to their Account, using the tab "My Account" (i.e. registration form) or through Customer Line.
The Customer Service Line is a toll-free customer support designed to eliminate technical problems, error, malfunction or the reduced functionality of the Website (see article III., section 3. Using and Managing the Website). Tesco is not responsible for the following consequences:
(A) giving false or incomplete information during registration, or the failure of the Customer to update it;
(B) making username and password available to third party Customers.
The Customer may terminate their Account for any reason, through the Customer Links. Tesco has the right to cancel a Customer's Account without giving reasons or information to the Customer if Tesco has reason to suspect that:
Registration expires upon the death of the Customer or termination of the Service by Tesco. The elimination or deregistration shall not affect the provisions of the GTC, which by their nature and essence persist even after the termination or cancellation of Registration.
The owner and operator of the Website is Tesco, which is in accordance with the relevant laws governing intellectual property rights, in particular Act No. 185/2015 Coll. Copyright Act, authorized to exercise intellectual property rights relating to the Website, including its contents, visualization, design, all graphics, as well as all databases forming its content.
The pictures of the Goods displayed on the Website are illustrative in nature, used solely for merchandise presentation and may vary slightly from the actual Goods. Photos and description of individual Goods are supplied by manufacturers, suppliers and Tesco.
All information contained on the Website, including trademarks, photographs, descriptions and applications, are protected by law. Any unauthorized use of them, whether total or partial, constitutes a violation of the law.
To use the Service on the Website the Customer’s end equipment must meet the following requirements: broadband Internet, an Internet browser that supports CCS and JavaScript, activated cookies support, activated pop-ups support, operating system and an active email address. Tesco is not responsible for proper functioning of a third-party services (a proper internet connection, etc).
The Customer and any other person is obliged to use the website in accordance with its purpose and GTC, and in accordance with bono mores and Slovak legislation, and is obliged to refrain from activities that may disrupt its proper functioning. The Customer and any other person shall in particular not:
otherwise, Tesco is entitled to cancel the Account of the Customer. The Customer is fully responsible for all operations carried out through their account on the Website. The Customer is obliged to inform Tesco without undue delay of any suspected misuse of their password (Account) by a third party. Where there is reasoned concern, Tesco is entitled to block the relevant Account, or invite the Customer to change the login password.
Tesco will regularly carry out activities to improve the quality of the operation of the Website. Using this Website may lead to errors or technical problems. In this case, the Customer should report such a situation to Tesco through the Customer Helpline on the toll-free number 0800 222 333 or email potravinydomov@itesco.sk (hereinafter "Customer Helpline"). Tesco then shall restore the proper functioning of the Website.
Tesco reserves the right to temporarily restrict Website access to the Customer (or part thereof) in order to improve it technically, carry out maintenance or update it, even without any prior notice sent to the Customer.
Tesco is not responsible for any damage or loss of profit incurred to the Customer directly or indirectly as a result of:
After successful Registration, the Customer can log in to their account on the Website by entering their username and password. The username and password are kept confidential. The Customer is responsible for all the actions of a third party resulting from the publication or disclosure of the username and password to a third party. After logging in the Customer can use all the available functions of the Services, in particular the creation of a Shopping List and the delivery order of Goods specified in the relevant Shopping List. Tesco sends to the Customer a confirmation of the Shopping List to the e-mail address the Customer provided during Registration.
Customers can create a Shopping List at any time 24 hours a day, 7 days a week. Tesco does not supply orders on 1 January, Easter Sunday, 24 December, 25 December, 26 December, as well as other Bank holidays during which Tesco stores are closed. After previous notice published on the Website, Tesco reserves the right to determine the following days when the supply of Goods will not be carried out, except the days referred to in the previous sentence.
If the Customer wants the Goods delivered the next day, the confirmation of the Shopping List must be no later than 22:59 (11 pm) of the preceding day. The same applies in the case of a change or cancellation of delivery of Goods or packaging option according to below section.
Tesco, by performing its business, tries to enhance the protection of the environment and offers this possibility to its Customers. Therefore, the Customer can choose from the following options of packaging and handover of the Goods:
By creating the Shopping List, the Customer performs the proposal for the supply of Goods contained on the Website.
Once the Order is submitted by the Customer, Tesco sends to the Customer a confirmation of the Shopping List to the e-mail address the Customer provided during Registration, or which is currently valid within his Account (hereinafter as “Electronic Order Confirmation”). The Purchase Agreement is concluded between Tesco and the Customer (the Order is accepted). The Purchase Agreement is concluded between Tesco and the Customer (Order is accepted) at the moment when Tesco electronically confirms the Customer's order to its email address given at registration.
The Customer agrees to use remote means of communication when concluding the purchase contract. The costs incurred by the Customer in using remote means of communication in connection with the conclusion of the purchase contract shall be borne by the Customer himself.
The Customer is entitled to cancel the Shopping List after logging in to their account on the Website or through the Customer Helpline. If the Customer cancels the Shopping List after 22:59 (11 pm), they can only do so through the Customer Helpline.
If the order shall be delivered the same day as the order was submitted, it can be cancelled or changed:
The Customer is entitled to order the delivery of Goods up to a maximum amount of 24 pieces of each item (if sold in pieces). In case the total amount of Order exceeds 260 kg, Tesco is entitled to cancel such Order and is not obliged to deliver it. The Customer may contact the Customer Helpline with further possibilities regarding ordering and delivery of requested Goods.
When ordering delivery of weighted Goods, Tesco reserves the right to deliver the goods whose the weight is different from the weights specified in the Shopping List, while the difference shall not be greater than +/- 10% depending on the type of goods. If the weight difference in the supply of Goods exceeds 10%, the Customer has the right to refuse accepting such Goods.
In the case of Goods whose price is determined in accordance with a unit weight and if its nature allows so and the Customer orders a number of items instead of the weight of Goods, Tesco will deliver the ordered number of items to the Customer. The price will then be determined by the weight of the ordered quantity of such Goods.
Creating a Shopping list online means selecting products shown on the Website in your trolley. Creating a Shopping list does not equal with the ordering of these products online, the Customer is not obliged to purchase products selected.
The availability of products shown on the Website may differ from a particular store’s product availability, it rather depends on the availability of products on the shopfloor of the particular serving store on the day of delivery, so Tesco does not guarantee continuous availability of all products. In order to ensure that the products are available to the highest possible number of the Customers, Tesco has the right to impose a ceiling as to how many individual items the Customer can purchase. In this case, the Customer cannot select a higher number or quantity of a product than the upper limit set by Tesco.
If the products selected by the Customer are not available, Tesco will endeavour to put forth its best effort to offer other products upon delivery the properties and prices of which are as close as possible to the Customer’s selection – in case the Customer has indicated he/she would like to receive other products substituting the originally selected ones. During the product selection, the Customer has the possibility to opt-in or opt-out for substitutions even on product or basket level. The price, package size and brand of the substitute product may differ from the price, package size and brand of the product the Customer selected. Upon delivery, these substitutes will be visibly separated from the other products selected by the Customer, and this will also be indicated in the e-delivery note sent over to the Customer in advance via e-mail.
In case the Customer is not satisfied with any of the substitute products, the Customer can hand them back to the courier, without any obligation to pay for them.
The Service costs on the Website is reported in EUR, including the relevant value added tax and without the price for Goods delivery. The current price of the Goods is listed on the Website after the registered Customer logs in to his Account. The price of the goods on the Website may be changed by Tesco at any time without giving a reason
The price of the Goods is always announced to the Customer in advance before concluding the purchase contract and before accepting its changes, via the Website. The Customer will be informed about the purchase price of the Goods in the relevant Order upon confirmation of this Order by Tesco and also via the electronic Delivery Note sent to the registered e-mail address of the Customer.
In the case of a proposal to amend the purchase agreement by the Customer in the sense of these GTC, a proposal to change the price of Goods for partial items in an already concluded purchase contract may be submitted to the Customer by Tesco. This proposal to change the price is Tesco's counter-proposal to the Customer's proposal to change the purchase contract, and the Customer is not obliged to accept this Tesco proposal. In the event that this Tesco counter-proposal is not accepted by the Customer, the purchase contract remains in force in its original form, including the price of the goods.
In the event that the Tesco counter-proposal is accepted by the Customer, the purchase contract will be changed, including the purchase price for the Goods for which Tesco has made a counter-proposal to change the price.
Furthermore, the Customer has the right to propose a change in the purchase contract to Tesco upon delivery of the ordered goods by rejecting some and / or all of the ordered items and Tesco accepts the Customer's proposal to change the purchase contract without any reservation. The Customer also has the right to proceed in accordance with Article IX hereof (withdrawal from the contract).
In the event of an order for weighed goods, Tesco reserves the right to deliver goods with a reasonable weight deviation. In this case, the price of the Goods may change depending on this weight deviation.
If the Customer orders a number of pieces instead of a specific weight, and the price of such Goods is determined by a unit of measure, Tesco shall deliver the required number of pieces. The price shall be determined according to the weight of ordered number of pieces of such Goods.
If the price of the delivered Goods differs from the price of the Goods in the confirmed Shopping List, the Customer has the right to refuse the purchase of such Goods directly upon its delivery. The price of the Goods were denied will not be withdrawn from the Customer's bank account, even if such data were entered before the Goods delivery by paying online.
Tesco delivers the Goods with a confirmed Delivery Note, proof of purchase (receipt), which includes:

If the Customer returns a product, they may request a corrected invoice for the returned goods via the Customer Helpline potravinydomov@itesco.sk. In the application it is always necessary to supply the Shopping List number. After receiving the request, the Customer will be sent the corrected invoice by mail to the address under which they are registered.
The Delivery Price is not included in the Service costs. The Delivery Price is paid for each order of delivery of Goods (hereinafter “Order”) and supply individually, i.e. irrespective of whether several supply orders relate to the same place and the same time of delivery. The Delivery Price will depend on the day of the week and time (i.e. time slot), in which the Goods are delivered to the Customer. Information on the Delivery Price or eventually free delivery is available on the Web Page for the creation of the Shopping List (hereinafter "the Delivery Price").
The Customer can choose one of the following methods of payment:
If the customer wants to pay the Goods price through the payment card online, they are required to activate the online payment service in the bank that issued their payment card before creating and confirming the Shopping List if they do not have this service active any longer, as well as to verify whether the validity of the payment card expires before the expected day of the Goods delivery.
If the Customer's payment card is no longer valid on the day of the Goods delivery, Tesco is entitled to refuse delivery of the Goods. The Customer acknowledges that if they want to pay for the Goods stated on their Shopping List by credit card online, Tesco is entitled to verify the payment card details with the Customer's bank. For the purposes of this verification, Tesco may, additionally request confirmation of the value of the Shopping List that corresponds to the Order´s amount (confirmed Shopping List) + 15% of this value for possible changes in the Order. The Customer is informed of this amount when placing and confirming the Order. Tesco does not verify or block this value in any way in the Customer's account. Tesco may be entitled to block the amount of EUR 1 from the Customer's bank account within the payment card authorization process in order to further validate the Customer’s payment card.
On the day of delivery of Goods to the Customer, the Service costs stated on the Shopping List and the Delivery price or other valid charges based on a Pricelist or these GTC, e.g. Minimum basket charge (together hereinafter “Fees”) are blocked on the Customer's account. After the delivery of the Goods, the price of the actually purchased Goods accepted by the Customer and the Fees shall be deducted from the Customer’s account. The charged price of the Goods stated in the Shopping List, the Fees and as the case may be the amount of 1 € detained for the purpose of authorizing the Customer's payment card will be released within the time limits specified by the Customer’s bank, on average within about 10 working days.
If the Customer does not accept any of the Goods referred to their Shopping List within the agreed time, the price of the Goods listed in the Shopping List along with the Fees and possibly the amount of 1 € will be detained and these amounts will be subsequently released within the deadlines specified by the Customer’s bank, on average within about 10 working days. The amount retained on the Customer's account will not be deducted from the Customer’s account. Tesco declares that it has no effect and is unable to influence the length of the periods during which the amounts are blocked on the Customer's account. To reduce the risk of unauthorized access to data on the Customer's payment card, the data will be encrypted. Payment by cash, meal vouchers, gift vouchers, Clubcard vouchers or other valuables is not possible within the Service.
Service costs in returnable packaging also include a deposit for this container. Information about the amount of the deposit is given for particular Goods. The Customer may return deposit packaging and recover the deposit during opening hours in any Tesco establishment, with regard to stock sold in this type of establishment. Packaging with deposit cannot be returned directly to the goods distribution Worker. Nor is it possible to apply a coupon for returned bottles with deposit put down via the Service
If you have obtained or received an E-coupon from Tesco in the form of a leaflet supplement to print, email or otherwise, such an E-coupon can be applied as a discount (voucher) in accordance with these standard terms and conditions of use for E-coupons. The amount of the discount is given on the E-coupon.
E-coupons acquired from Tesco, whether printed, electronic or other form, may be used only for purchases through the Service provided by Tesco on the website www.tesco.sk/potravinydomov in accordance with these Terms of Use for E-coupons. The validity and duration of the E-coupon is listed on the E-coupon.
The E-coupon can be applied by entering the code in the appropriate place during the electronic purchase in the Payment section. Eligibility to obtain an E-coupon may be subject to control consisting in the submission of a document/subsequent confirmation of eligibility to use an E-coupon.
Eligibility to use an E-coupon is automatically controlled by the electronic system. Using the E-coupon constitutes your unconditional and irrevocable consent to be bound by these terms and conditions for the use of E-coupons. Tesco reserves the right at any time and for any reason to cancel or change the conditions of use for E-coupons. E-coupons are the property of Tesco. The right to use an E-coupon is related to the original beneficiary (personal right) and cannot be transferred to another person, unless the E-coupon states otherwise.
E-coupons may not be copied, reproduced, distributed, published or disposed of, directly or indirectly (through another person) or in any other way. E-coupons distributed in any way, displayed or otherwise marketed without the prior consent of Tesco (i.e. the unauthorized disposal of an E-coupon) are invalid and no property rights arise from them.
Unless explicitly stated otherwise, an issued E-coupon:
Some of the goods or services are excluded from E-coupon offers. With the E-coupons you can not buy tobacco, tobacco products, infant and baby food and prescription drugs (i.e. excluded goods). Tesco reserves the right to determine other goods or services that may be excluded. Any such exclusion of goods or services will be stated on the E-coupon or will be published on the website www.tesco.sk/potravinydomov. Excluded goods or services are not included in the created shopping list or purchase and therefore they are not subject to any discount.
To use the E-coupon it is necessary to perform a (individual) purchase of designated/posted goods and services in the minimum amount listed on the E-coupon (hereinafter referred to as the "minimum purchase"). A minimum purchase is considered a purchase made via the Service in the minimum value stated on the E-coupon. An individual purchase means the actual receipt of the goods or services and payment of the purchase price for the accepted goods. Excluded goods, Fees and other payments, which are not directly payments for Goods, are not included in the minimum purchase.
The value of the minimum purchase amount and its respective discount will be shown on the E-coupon. The discount will be performed after fulfilling all the conditions of applying the E-coupon from the total purchase price of the goods or services. The prices of Goods and services include VAT. Discounts are not applicable to Fees.
By using the E-coupon you are liable to Tesco that you are a proper and authorized recipient/customer and the holder of the E-coupon and at the same time that you use it in good faith (bona fide). Where there is reasonable suspicion on the part of Tesco that the recipient/customer/holder is a corrupt holder, for example, by obtaining the E-coupon otherwise than provided in these GTC (through purchase, fraud) or commits an offense or illegal act, Tesco reserves the right to unilaterally refuse to accept an E-coupon obtained through the breach of these GTC and reserves the right to cancel any E-coupon. Tesco reserves the right to take any other action it deems appropriate in such cases.
Tesco accepts no responsibility for any financial loss resulting from the refusal, cancellation or withdrawal of any E-coupon or inability of the customer/recipient/holder or a household to properly enforce the rights arising from the E-coupon, or for any other reason.
Tesco reserves the right to modify or terminate all E-coupons, changing their conditions at any time without notice.
The "Click+Collect" service is an additional service to the Service. The "Click+Collect " service allows Customers to pick up the Goods ordered through the Service in person at the Collect Point. The Customer of the Service thus has the option of choosing between the delivery of the goods by Tesco to the required place of delivery or personal collection. The condition for using the "Click+Collect" service is its availability for the Customer. The "Click+Collect" service is available only for Customers who, according to the place of registration, fall into the individual areas of the Slovak Republic in which the Service is available ("Collect Point"). Information on the availability of the "Click+Collect" service will be available to the Customer at the time of entering the individual requirements of the Order into the web application of the Service. The Collect point is clearly marked with the "Click+Collect" service logo. Information on the price of the Service using "Click+Collect" will be available to the Customer at the time of entering individual requirements of the Order into the web application of the Service.
The appropriate provision of these GTC applies to the "Click+Collect" service, Art. IX Delivery of Goods. The following applies to the collection of the Goods within the "Click+Collect" service:
The goods at the Collect Point may only be taken over by a person over the age of 18 who has executed the Order and who tells the employee the number of the Order. It is not possible to deliver the goods to the Customer without submitting the Order number. If the dispatcher has doubts about the person's entitlement to take delivery of the goods, he is entitled to request an extension of the identity document from such a person in order to prove his age and identity. Tesco will not release the goods unless the takeover authorization is proven.
If the Goods selected by the Customer are not available and if the Customer has indicated that he wants to receive a replacement product when the selected products are not available, Tesco will send an electronic delivery note to the Customer to change the content of the purchase contract and the company will make every effort to deliver the goods. designed other products whose features and price were as similar as possible to the Customer of the selected product. During the selection of products, the Customer has the opportunity to express consent or disagreement with the replacement of the product, both at the level of the individual product and at the level of the entire shopping list. The price, package size and brand of the replacement product may differ from the price, package size and brand of the Product selected by the Customer.
Upon receipt of the goods by the Customer, these replacement products will be separated from the other Goods ordered by the Customer and the Customer is entitled to reject in whole or in part and Tesco automatically accepts such Customer's proposal to change the purchase contract. The customer also has the right to proceed according to Art. X. of these GTC (Withdrawal from the contract). A customer who has provided their payment card details in advance for the purpose of online payment will not be deducted from the payment card for the unclaimed goods.
Delivery of goods within the service is carried out on the days and at the time shown in the “Book time” section, except where provided otherwise in these GTC. Tesco delivers the goods at the earliest on the next day following the confirmation of the customer’s shopping list, if this day was shown as the earliest possible date of delivery. Tesco is committed to making every effort that may be justly required from it to perform the delivery of Goods on the agreed date and agreed time. Tesco is not responsible for late delivery due to force majeure or other unpredictable events (i.e. accidents and congestion on the roads).
Tesco does not guarantee the availability of the Goods presented on the website. If the Goods ordered by the Customer are not available, Tesco is entitled to offer replacement goods to the Customer, whose features and price are similar or the same as the price of the ordered unavailable Goods (hereinafter referred to as "Replacement Goods"). The Customer will also be informed about the delivery of the Replacement Goods via an email sent on the day of delivery of the Order (Electronic Delivery Note) as well and such Replacement Goods will be separated from those ordered by the Customer. Upon delivery of the goods, the Delivery Note will be handed over to the Customer at the same time in paper form. This Delivery Note is identical to the Electronic Delivery Note, but the Delivery Note legally prevail. The Electronic delivery note is for information purposes only.
In this section, the delivery of the Replacement Goods specified in the Delivery Note is considered a proposal for the conclusion of the contract by Tesco. The Purchase Agreement in relation to the Replacement Goods is concluded between Tesco and the Customer on the day of delivery of the Customer's Order (acceptance of the Replacement Goods by the Customer).
The Customer has the right to refuse to accept the entire Replacement Goods, as well as its parts. Price of the Goods not accepted by the Customer will not be included in the total payment for Goods, even if the Customer has previously entered data on the payment card to make the payment online.
In case of sale of Goods within the promotion of the Goods or their discounted sale whose amount is limited. The supply of such Goods depends on the order in which individual Customer Shopping Lists were delivered to Tesco. Tesco reserves the right not to supply the Goods if the goods from the promotional event are sold out.
Tesco delivers Goods exclusively in areas that can be discovered by clicking on the link in "Where We Deliver" and enter the postcode. Delivery is possible only to those Customers whose shipping address is located in the area covered by the use of Tesco within the Service. The Goods will be delivered to the door of the apartment or the house of the Customer, whose address was listed as the place of delivery. Within the Service, the Customer may request the delivery of Goods to a certain floor, while Tesco or the Worker of distribution to customers (hereinafter "the Deliverer") will make reasonable efforts to deliver them to the place designated by the Customer and must simultaneously satisfy all of the following conditions:
If on the agreed time of delivery the Customer is not available at the stated delivery address, the Deliverer shall leave them a note at the place designated for delivery of mail (Customer’s mail box).
If the absence of the Customer is just temporary and the Deliverer is still located near the site of delivery, the Customer may contact the Customer Helpline and request that the Deliverer deliver the Goods to the Customer at an agreed alternative time. If the repeated delivery is possible on the same day, after agreement it will made at a new time of delivery. If the Deliverer is not close to the place of delivery and delivery on the same day is not possible, the Shopping List will be cancelled. The unsuccessful delivery of Goods for reasons based on the Customer's side establishes the right of Tesco for payment of the Delivery price.
Tesco reserves the right to refuse performing further deliveries to the Customer who has ordered the delivery of Goods and never once was located at the specified (agreed) place and time of delivery three times or more within one calendar month. Or if the Customer did not select any Goods from the delivered Goods and therefore the purchase agreement could not be concluded three times or more within one calendar month.
Tesco reserves the right to additionally inspect the data of the Customer, the Customer Shopping Lists and the delivery order of Goods, i.e. phone. Tesco reserves the right to refuse delivery of the Goods referred to in the Shopping List if it has reasonable grounds for suspecting that the Goods were ordered in violation of these GTC.
The Service price stated on several Shopping Lists with the same time, date and address of delivery will be charged for each Shopping List.
Tesco reserves the right to check the age of the person acquiring Goods at the point of delivery. If a person below the age of 18 years and the Goods cannot be taken by another person Tesco shall refuse the delivery of Goods to such a person, especially if the Goods are, for example, alcoholic beverages, cigarettes and the like.
The Customer may authorize the receipt of the Goods at the place of delivery only for a person older than 18 years of age. Tesco may not pass on alcoholic beverages to persons under 18 years of age, or persons under the influence of alcohol.
Complaints of defective Goods shall be governed by the Tesco complaint (here).
The Complaints Procedure does not exclude that Tesco may allow Customers to file complaints and claims in other ways (while maintaining the Customer's rights under applicable law), which would in particular simplify resolution of such Customer´s claims. Such rules, if any, will be published by Tesco on the Website
Alternative resolution for consumer disputes (ADR) is a process aimed at achieving an amicable settlement between consumers and entrepreneurs (traders) and preventing litigation between the two entities. If the Customer is dissatisfied with the outcome of their application for redress and the attempt to resolve a dispute with the entrepreneur is inconclusive, they have the right to submit a proposal to an appropriate entity for alternative dispute resolution, which in this case, for example, is Slovak Trade Inspection. Slovak Trade Inspection has all the necessary information about alternative procedures, through which the Customer can solve any dispute. The supervisory authority over Tesco: government authorities in the field of Public Health, State Veterinary and Food Administration Office on the offer and sale of food, the Department of Public Health of the Slovak Republic and regional public health authorities over the supply and sale of cosmetics, Slovak Trade Inspection over the offer and sale of products and provision of services.

Respective legal provisions applicable and effective in the Slovak Republic apply to the rights and obligations not governed by these GTC. All disputes arising out of the Services, unless the parties reach a settlement, will be settled by a competent Court of the Slovak Republic.
Tesco reserves the right to change these GTC. Changes shall not violate or restrict the rights of the Customer arising out of Shopping Lists and a performed delivery order before the entry into force of such changes. Tesco is entitled to change these GTC, in particular, but not only if any of the following reasons occur: changes in marketing strategy, changes in market conditions in the provision of similar services, due to technological development, enhancing of the Customer rights or his possibilities, due to increased Tesco costs or inflation according to the Statistical Office of the Slovak Republic, legislative changes or Slovak government decisions, or decisions of a public administration body or an EU body or for reasons caused by force majeure (e.g. natural disaster, virus, war).
Changes to these GTC shall be valid from the date of publication on the website. Tesco shall announce the changes to the GTC by sending a notice to the Customer by e-mail, including the reference to the text changed hereof. If the Customer does not agree with the change to the GTC they shall be entitled to cancel their Account on the Website.
These GTC are available on the Website, especially when registering the Customer, after logging in to the Service and easily accessible within the creation of the Shopping List and confirmation of the Order. These GTC are available on the Website in Slovak as well. In the event of any inconsistency between the Slovak and English versions, the Slovak version of the GTC shall prevail.

The Tesco Clubcard Loyalty Program is owned and operated by TESCO STORES SR, a. s., with its registered seat at Cesta na Senec 2, 821 04 Bratislava, Slovak Republic, ID number: 31321828, registered within Comercial Registr held by District court Bratislava I, section: Sa, insert: 366/B (hereinafter as “Tesco”). Tesco Clubcard Loyalty Program is dedicated to customers of Tesco stores and users of Tesco Online Shopping Service, and it enables them to collect points on personal account for shopping at Tesco stores in Slovak Republic or via Tesco Online Shopping service. (hereinafter as “Clubcard Program” or “Program”). In return for the point collected, Tesco from time to time may give the customers various rewards and also may provide additional benefits to Members. More information about the Clubcard Program is available at Clubcard Program website https://tesco.sk/clubcard/ and at customer service desk in each store, at toll free Customer Engagement Center line 0800 222 333, or email address: tesco_sk@tesco.com.
All natural persons over the age of 18 with a delivery address in the Slovak Republic can participate in the Program who agree to these general terms and conditions of the Program(hereinafter referred to as the "Member"). Legal entities and entrepreneurs cannot participate. Only one Clubcard account can be used, multiple memberships are not possible. By registering to the Clubcard Program the customer agrees to the terms and conditions of the membership and declares that he/she has acknowledged with its content.
After registration, the Member may receive a physical card (hereinafter as the “Clubcard”) upon his/her choice. In the case of submitting an application online, via the app, etc., the Clubcard will be provided to the Member via in electronic form, the form will be accessable via Clubcard mobile application. Each Clubcard, physical or digital, has its individual Clubcard number that is assigned to the Member. The usage of Clubcard is considered to be the acceptance of the terms and conditions. The Clubcard is owned by Tesco and it is dedicated for collecting points for purchases. It can be used by the Member only and cannot be traded for financial gain. The Clubcard can only be used for end-user purchases. When VAT invoice is issued, it cannot be validated in that transaction. Given that Tesco is a retailer and offers goods to final consumers, Tesco reserves the right to deduct any points from the personal Clubcard account of the Member that has been received for purchases intended for business purposes. Tesco also reserves the right to suspend or terminate membership in the Clubcard Program of a Member in case there are reasonable doubts that purchases made by the Member are intended for business purposes (in terms of volume of purchases) not for personal consumption. Tesco reserves the right to deduct points from personal Clubcard account and to suspend or terminate membership in the Clubcard Program of a Member also if there is a reasonable suspicion of any other fraudulent and unjustified activities aimed at gaining Clubcard points in an unauthorized way or for any other reason Tesco considers as a violation of this terms and conditions or breach of the good moral and ethical behavior as to Tesco’s standard.
Clubcard can only be used at Tesco and at Tesco’s contractual partners. There can be different conditions applied at the contractual partners, for further details please contact the partners.
If you lost your Clubcard, please, contact Customer Engagement Center line where you can apply for a new card and have your points merged with the previous lost one. To apply for the new card, and to merge it with the lost card, the data and the Clubcard number of the previous one are required again.
If you do not know the number of your previous card, our colleague at Customer Engagement Center line can help you after data reconciliation. Two cards can only be connected in this way if the lost card and that the newly activated card is owned by the same person. Tesco reserves the right that if this condition is not met, delete the unauthorized points.
In order to be able to assign the points for the purchase and to use other Clubcard benefits, the Member needs to be correctly registered for the loyalty program and Member needs to use his Clubcard registered in his My Clubcard Account at checkout at the time of payment when shopping in a store or through the Tesco Online Shopping service. Registration can be done via the Tesco website, the Clubcard application or Customer Engagement Center line.
Points credited using the Clubcard issued for one My Clubcard Account will be cumulated on respective My Clubcard account. Clubcard points can also be collected under additional terms & that will supplement this Terms & Conditions, as issued and amended from time to time.
If the Clubcard is not properly and completely registered in the My Clubcard Account, it will not be possible to collect points on this Clubcard. Tesco reserves the right to cancel unregistered and anonymous Clubcards and at the same time not to provide Clubcard points.
The minimum purchase amount for which points are assigned is 1 EUR. For every 1 EUR spent, 1 point will be assigned to the account and when buying fuel at any of the Tesco gas stations, 1 point will be assigned for every 1 liter of fuel. The value of 1 point is 1 cent. Tesco reserves the right to determine the maximum purchase amount for which points will be assigned.
Tesco reserves the right to change these conversion rates at any time, and each change will be effective on the date of its publication on the webpage: https://tesco.sk/clubcard/ and https://tesco.sk/podmienky-pouzivania/ENG.
Points are recorded on the Member's personal account and the total number of points collected by the Member is displayed on the receipt for the purchase made, it is also available in the personal online account of the member v Tesco Clubcard application or My Clubcard account. Points are not transferable to another Member.
In the event that points are not assigned to the Account after submitting the Clubcard at the checkout, the Member is entitled to file a claim in the same Tesco store at the customer service desk, presenting the receipt or other document proving the purchase within 1 calendar day after the purchase. Later complaints will be disregarded. In the event that the customer fails to submit the Clubcard, the points cannot be credited later and the complaint is disregarded.
In case of returning an already purchased product within the "Inappropriate purchases" service, the points will be earned for purchase of this product automatically deducted.
The collection point does not apply to catering and gift certificates for the purchase of packings; tobacco products and electronic cigarettes; initial infant formula; newspapers and magazines; an advance payment for returnable bottles and containers, shopping bags. These products are also excluded from the use of coupons and discount voucher. Based on decision by Tesco, there can be other products for which points cannot be collected in the future. Payments to Financial Services products and services (including bill payments, mobile phone top up, international money transfer, banking, insurance and travel products) are also not covered by points counting unless defined otherwise for specific products and services or promotions connected with those.

Points collected on the account do not have monetary value until they are not converted to vouchers either in the Clubcard application by the Member or by Tesco at the end of the collection period.
Accumulated points are converted into rewards. Rewards in the form of Clubcard vouchers will be sent to all Members who have collected the minimum required number of points in the relevant period, unless the Member has already transferred them to coupons in the Clubcard mobile application.
The minimum number of collected points required to obtain Clubcard vouchers and the date of the next billing are available at www.clubcard.sk and on the Customer Engagement Center line, in the Clubcard application or in My Clubcard account. The total value of the Clubcard discount voucher depends on the number of collected points rounded to multiples of fifty.
The number of points that exceeds a multiple of fifty is automatically transferred to the next period, as well as the points of those Members who did not collect the minimum number of points for obtaining a Clubcard discount voucher for the given period. The value shown on Clubcard vouchers cannot be redeemed in cash. Unspent value of Clubcard vouchers will not be refunded but can be carried over to the next period.
Clubcard vouchers cannot be exchanged for cash. Rights to rewards linked to purchased goods, as well as Clubcard vouchers, are nontransferable. If Clubcard vouchers are showing signs of alteration and/or damage, Tesco reserves the right to reject them.
Customers can also receive additional Clubcard coupons that can be redeemed in the same way as other Clubcard coupons. Tesco reserves the right to independently decide on the number of additional coupons addressed to customers during the calendar year.
In addition, Members can receive additional coupons for a discount immediately after payment for the purchase printed out after the receipt. These additional coupons cannot be used in Tesco online purchases and at Tesco petrol stations. Tesco reserves the right to provide additional ways of spending or redeeming points for Members.
Only the Member is duly authorized to be the recipient of the rewards and he/she can use them only in good faith. If the Member redeems, attempts to redeem, or encourages the redemption of rewards to obtain discounts to which he/she or a third party are not entitled he/she might be committing a unlawful conduct. If Tesco suspects that any rewards or points are being used unlawfully or against its original purpose, Tesco may reject or cancel any rewards and/or points concerned, and the Member will have no right to claim against Tesco in respect of any rejection or cancellation made by Tesco as a result of the aforementioned misuses. Tesco reserves the right to take any further action it deems appropriate in such instances. Rewards distributed or circulated without the written approval of Tesco in any manner, especially on an Internet website or social media platform, are not valid for use and may be rejected or cancelled immediately.
Members should register their Clubcards on My Clubcard Account and obtain access to additional services and functionalities within My Clubcard Account, such as tracking points, the electronic update of their personal data, view transactions made using the Clubcard from the current one and from the previous two Clubcard billing periods, electronic access to active rewards with the possibility of printing them, the ability to change the preferences of contact and give additional marketing approvals. E-mail is required for registration to the My Clubcard Account.
After registration, Members get individual access to My Clubcard Account by logging into it providing an email address and a password.
Tesco may limit or block the functionality of My Clubcard Account for a definite or indefinite period in case that the Member violates the conditions of use of My Clubcard Account or if there is a reasonable suspicion of access to My Clubcard Account by unauthorized persons. In order to remove access to My Clubcard Account, please contact the Customer Engagement Center line or Tesco Contact Office.
Members are able to download the Clubcard Mobile Application free of charge using mobile devices equipped with the Android 5.0 operating system and newer, iOS 11.0 and newer. The Clubcard Mobile Application is available for download in official Google Play (Android) and App Store (iOS) stores for free. Clubcard Mobile Application uses data transfer and therefore using it by the Member may result in charging the fee in accordance with the price list applicable to the operator. Clubcard Mobile Application enables access to the services and functionalities of My Clubcard Account, scanning the Clubcard and using it in electronic form, as well as using the rewards in electronic form.
Any claims relating to the crediting of points to the Clubcard must be made at the time of the purchase to which the crediting of points relates at the customer servis desk. Later complaints regarding the crediting of points will not be taken into account. If the Member does not receive the vouchers to which he is entitled after the end of the relevant Clubcard period, and at the same time does not raise his complaint on the toll free Customer Engagement Center line or via email: tesco_sk@tesco.com within one month from the expected date of receipt of the bill indicated on the receipt, his right to receive them shall cease. Points for undelivered Clubcard vouchers can be transferred to the next period based on a successful customer complaint. Tesco is not responsible for the delivery of any parcels to Clubcard Members by the courier. All possible complaints, objections or disputes in connection with the Clubcard program are decided by Tesco with final effect. With objections, complaints and claims regarding the crediting of points for purchases of goods and services from contractual partners, the Clubcard Member is obliged to contact this partner directly. Tesco is not responsible for the obligations of the partner and any liability of Tesco in connection with the services of the contractual partner is excluded.
In cases where the Member withdraws from the contract in respect of goods for which Clubcard points have been awarded, Tesco may deduct points from the Member's account equal to the value of the returned goods in accordance with the converted value according to which they were calculated.

Membership can be terminated at any time by the Member by calling the toll-free Customer Engagement Center line, by filling out the contact form at tesco.sk, or by deleting Clubcard account in Clubcard application. Membership expires at the expiration of 30 days from the time of receipt of Tesco's termination request.
The membership is also cease to exist upon Member’s death or by the date, the Member is legally declared dead. The membership and the rewards associated with this membership are not legally enforceable and can not be the subject of inheritance proceedings.
Tesco shall be entitled to terminate the Membership and delete accumulated points from the account with immediate effect if:
The moment of cancellation or termination of membership for any reason will invalidate any points you have so far accumulated, but not spent, and Customer cannot for that reason claim any refund or damages from Tesco.
Tesco is entitled to change these Terms and Conditions at any time, the rights obtained under previous versions of these General terms and conditions will be fully respected. The new Terms and Conditions are valid on the day of its publication on the webpage https://tesco.sk/clubcard/ and https://tesco.sk/podmienky-pouzivania/ENG.
Tesco reserves the right to terminate the Clubcard Program at any time. Once the new Term and Conditions become effective, it is considered that the member agrees with the change of terms when the card is used during a payment transaction.
Tesco reserves the right to terminate the Clubcard program at any time.
If these General Terms and Conditions are available in another language than the Slovak language, the Slovak version always takes precedence over any other language version.
In all matters not covered by these Terms and Conditions, the provisions of Slovak Republic law shall apply.
Any disputes arising from participation in the Clubcard Program will be settled amicably, in the absence of a satisfactory agreement, disputes will be subject to resolution by a court competent in accordance with the applicable provisions.
Out-of-court resolution of consumer disputes is a system that enables an alternative procedure outside of the classic court process when resolving disputes between consumers and entrepreneurs. In the event of dissatisfaction, the Member may, with his initiative, turn to the subject of out-of-court dispute resolution, which in this case is the Slovak Trade Inspection as the competent state supervisory body. The Slovak Trade Inspection has at its disposal the necessary information about the alternative procedure by which the Member can resolve the dispute. More information on out-of-court settlement of consumer disputes can be found at the website of the Slovak Trade Inspection: www.soi.sk.
If there will be any changes in the personal data provided in the registration form, customer must report it to Customer Engagement Center line or to Contact Office. Tesco does not have any responsibility for any issues coming from the absence of reporting. Customers have the responsibility to keep Cards, and rewards safe. Tesco does not have any responsibility for any issues coming from the absence of these safety measures. If a Tesco employee gives any information that is contradictory to these Terms and Conditions, it is not equivalent to the amendment of it.

These general terms and conditions (hereinafter referred to as “TOC GTC”) set forth a description and the terms of Tesco Online Club membership service of TESCO STORES SR, a.s. with its registered seats at Cesta na Senec 2, 821 04 Bratislava, Slovak Republic, Company Identification Number: 31 321 828, registered by Commercial Register of the Municipial Court Bratislava III, section: Sa, file number: 366 /B (hereinafter referred to as “Tesco”).
Tesco Online Club is an additional membership service to Tesco Online Shopping (Grocery Home Shopping) that provides various benefits to members. The TOC GTC defines the description of Tesco Online Club membership service, the conditions of its use, and regulate the rights and obligations between the ustomer and Tesco within the framework of the service.
Application: the Tesco Online nákupy application.
Website: tesco.sk website.
Customer: the recipient of the Service, a natural person over the age of 18, who accepts the General Terms and Conditions of Tesco Online Shopping. A legal person or a natural person–entrepreneur may not become a Customer.
Confirmation: Confirmation sent via the Interface and via email by Tesco confirming the payment of the Membership Fee.
Shopping: products as a whole selected by the Customer on the Interfaces for delivery.
Interfaces: Website and Application together.
Home delivery: the method of acceptance of the Shopping, in which Tesco delivers the Shopping selected by the Customer to the delivery address provided by the Customer.
Member: Customer with an activated Membership.
Membership: Tesco Online Club membership.
Membership Contract: Membership service agreement concluded by and between the Customer and Tesco after submitting the Request and the payment of the Membership Fee upon receiving the Confirmation.
Membership Fee: The fee charged by Tesco for the Tesco Online Club Membership. The Membership Fee is divided proportionally into monthly payments that are deducted regularly on a monthly basis for the duration of the Membership Contract.
Membership Plan: A type of the Membership, which has been determined by the duration and/or other characteristic and which includes each automatic renewal of Membership.
Renewal: Automatic renewal of the Membership Plan on the last day of the current Membership Plan unless the Member does not switch it off . Renewal is set by default while joining TOC. With the Renewal the duration of purchased Membership Plan is prolonged by the same. Time period.
Request: the conduct of the Customer when, after choosing the Membership Plan, clicking on the button expressing the intention for joining to submit his/her request for the Membership to Tesco.
Service: Tesco’s Tesco Online Shopping (Groceries Home Shopping), which provides Customers with the opportunity to purchase products and available via the Interfaces.
TOC service: Tesco Online Club membership service.
Tesco Group: means Tesco's parent company and its subsidiaries, affiliates and joint ventures including Tesco itself.
Withdrawal Period: the 14 days’ period from the day of activating the Membership or day of Renewal.
The Customer may apply for Membership through the Interface and enjoy the benefits associated with a Membership for the stipulated Membersip Plan. The preconditions of the Membership are that the Customer:
The benefits of the Membership may be activated in the Tesco Online Shopping (Groceries Home Shopping) user account of a Customer. All benefits of a Tesco Online Club Membership are solely related to the Member's user account and email address. The benefits of the Membership are available to the Member after logging into the Tesco Online User Account and are specifically due to the Member when using the Service.
The full list of Membership benefits is presented to Customer before the Membership Contract is concluded and is also available here https://potravinydomov.itesco.sk/online-club. The Member acknowledges that the list of Membership benefits may change.
The Customer may apply for a Tesco Online Club Membership after logging in to Tesco Online Shopping (Grocery Home Shopping) account on the Interfaces by selecting the appropriate Membership Plan and clicking on the button expressing the intention for joining, submitting the Request. After submitting the Request customer is directed to a secure internet bank card payment interface, on which the Customer can pay the Membership Fee related to the Membership Plan using his / her bank card details. By sending the bank card details the customer expressly states that he or she would like to become a Member. Right after the payment is done Tesco will send the Confirmation. Upon Confirmation of the Request the Tesco Online Club Membership Contract is concluded and Membership will be established, the Membership will be valid. From the moment of conclusion of the Membership Contract, the Tesco Online Club Membership is activated in the Member's Tesco Online user account and the Member becomes entitled to the benefits of the Tesco Online Club Membership.
The Membership will be activated before the expiry of the 14-day period for withdrawing from the Membership Contract. The right to withdraw from the contract within 14 days remains, whereby Tesco will refund the full Membership Fee paid to the Member if the Membership Contract is withdrawn.
Upon joining Tesco Online Club, the Renewal is activated, and Membership Contract will be renewed for the same period as purchased Membership Plan. Member can switch the Renewal off in his/her Tesco Online Club account till the day before the last day of his/her current Membership Plan. In such case the Membership Plan expires at the end of the stipulated period.
The Customer agrees to use the means of distance communication when concluding the Membership Contract. Expenses used for distant communication in order to submit a Request does not vary from the basic rate, i.e. the price charged by the Customer's operator for data connection. Tesco does not charge any fee for such data connection.
The Membership Plans and Fees are available here and via the Application.
The Membership Fee depends on the selected Membership Plan.
The Membership Fee is final, in EUR and includes VAT.
After payment of the Membership Fee, Tesco will send the Member a receipt or invoice in accordance with the applicable legal provisions to the e-mail address associated with his / her user account.
Tesco Online Club Membership can be paid online via Visa and Master Card payment cards. No other payment method is possible.
The Membership Fee will be deducted on or after the day the Member concludes the Membership Contract and every month until the end of the Membership Contract. The debited amount and frequency depend on the chosen Membership Plan. Tesco will try and ensure the Member’s Membership Fee is deducted on the same day of each month.
The Membership Fee will also be debited automatically each time the Membership Plan is renewed until the Member exercises his/her right to cancel Renewal according to Section X. of these GTC.
The Members’s Membership will be Suspended if Tesco is unable to process the payment of the Membership Fee. This can happen for example if a Member’s payment card has expired or there is not enough cover on it. This Membership Suspension will continue until Tesco receives the Members’ Membership Fee. If the Member does not update his/her payment card data within 41 days after the original termination date of the Membership Plan, the Membership will be cancelled. If the payment card details are updated within 41 days after the original termination date of the Membership Plan, the Membership will continue and will be extended for the period corresponding to the period of suspension. During the Membership Suspension, the Membership Fee is also suspended, and the Member cannot use the Benefits of Tesco Online Club. Although, once the payment card details are updated and the Member is able to continue using the TOC service, he/she is obliged to pay the Membership Fee until the end of the Membership contract.
Pursuant to the applicable legislation, the Member is entitled to withdraw from the Tesco Online Club Membership Contract within 14 days of the conclusion of the Membership Contract or within 14 days from the automatic renewal of the Membership Plan without giving reasons and the Member iis obliged to inform Tesco of this fact. Upon such withdrawal, the Member will not be entitled to any benefit of the Membership, given that in such cases the Membership ceases to exist upon notifying Tesco.
To exercise the right of withdrawal, the Member needs to inform Tesco of his/her decision to withdraw with an unequivocal statement made by any means of contact listed in Section XVI. For this purpose, the Member may use the sample form of contract withdrawal here or can submit withdrawal request electronically here. The deadline for contract withdrawal is maintained if the Member sends a notice regarding the exercise of the withdrawal right before the expiry of the Withdrawal Period. Upon receipt of the withdrawal, i.e. after completing the form, the paid Membership Fee for the affected Membership Plan shall be credited to the Member within 14 days after the date on which Tesco received notification of withdrawal from the Member.
The Membership Contract is concluded between Tesco and the Member for a fixed period of time, namely for the Membership Plan selected during the activation of the Membership by Customer. The Membership Contract is automatically and repeatedly renewed at the end of each Membership Plan unless and until the Member turns off the Renewal or provides Tesco with notice to terminate the Membership.
If the Member turns off the Renewal, the Membership Contract will end at the end of the selected Membership Plan.

By signing up for Membership, the Member authorizes Tesco to take the Membership Fee each month and when Membership automatically renews. This will be done using the payment details from the payment card that the Member has provided to Tesco upon signing up for Membership. To Members who have cancelled the automatic renewal of the Membership Tesco will send reminders about the fact of being close to the end of the period of the Membership. If the Member requires to remain a Member of the Tesco Online Club Membership after the end of the prepaid period, she/he must activate the Membership again by purchasing a new Membership Plan.
The Membership contract expires at the end of the last day of its duration if not Renewed. This means at the end of the last day of the Membership Plan, if the Membership Plan has not been renewed.
If the Customer’s Tesco Online account is terminated for any reason, such termination will result the termination of the Membership as well. The Member is not entitled neither to full nor to partial refund of the Membership Fee. This does not apply if the Member cancels the Service within the Withdrawal Period according to point VIII. of these TOC GTC and in the event of cancellation of the Service according to the Article XIV. of these TOC GTC.
Cancellation of the automatic Membership Plan Renewal.
To stop automatic Membership Plan Renewal, the Customer must notify Tesco by visiting the My Membership Plan page or by means of contacts listed in Section XVI. If the automatic Membership Plan renewal is cancelled, the Membership Contract ceases at the end of the current Membership Plan. The Member is therefore not entitled to a refund of the already paid Membership Fee, or part of it, and has access to all the benefits of Membership until Membership is terminated Delivery charges will apply for any order that is to be delivered after the end of your Membership Plan.
Tesco has the right to cancel Tesco Online Club Membership if Tesco has reason to suspect that the Member has violated the TOC GTC or legal provisions, and/or Member misuses the Membership.
The Member may not assign or transfer Tesco Online Club Membership or any rights or obligations arising from it to a third party, even free of charge.
Tesco reserves the right to temporarily suspend the TOC service for technical reasons.
Tesco shall not be liable for any damages or any other consequences incurred by Member as a result of or in connection with the conduct of individual Member, how the Interface is used by Member or other circumstances incurred by Member.
Tesco is not liable for damages caused by force majeure or for failures of the Interface caused mainly by interruptions in the power supply.
Tesco reserves the right to temporarily limit the provision of all benefits associated with the Membership. Such a limitation of the provided benefits may be caused by an extraordinary and unpredictable situation, which may lead to temporary exhaustion of Tesco's capacities (especially a state of emergency caused by the uncontrolled spread of the disease (e.g. COVID-19) or unexpected nationwide and/or local restrictions or other competent authorities).
Tesco is not responsible for the smooth, uninterrupted, error-free, and secure operation of the Interface. Tesco is not liable for advertising or promotion carried out by any third party through the Interface or for errors caused by third-party intervention on the Interface or as a result of its use contrary to its intended purpose.
Furthermore, Tesco is not responsible for the services provided by entities other than Tesco, in particular the payment system operators, or rights and obligations connected to the abovementioned services provided by the third party.
The Member, may make his / her complaint in writing or in person relating to the conclusion of the Membership Contract or to the Membership Service. Tesco immediately investigates the oral complaints and remedies them as necessary. If the Member disagrees with the handling of his /her complaint or the complaint can not be investigated immediately, Tesco will respond in 30 days to any written complaint made in this regard.

Tesco notifies the Member of the manner of handling the complaint under in accordance with applicable law.
Out-of-court resolution of consumer disputes is a system that enables an alternative procedure in resolving disputes between consumers and entrepreneurs, outside traditional judicial proceedings. In the event of dissatisfaction, the customer may file a complaint with an out-of-court dispute resolution body, which in this case is the Slovak Trade Inspection Authority, as the competent authority of state supervision. The Slovak Trade Inspection Authority has the necessary information about an alternative procedure that can be used by the consumer to resolve the dispute. For more information about the out-of-court resolution of consumer disputes, please visit the Slovak Trade Inspection Authority’s website at www.soi.sk. The supervisory body of Tesco in the provision of services is the Slovak Trade Inspection Authority.
Tesco is entitled to change or supplement these TOC Terms and Conditions and Fees to a reasonable extent at any time, of which Members will be informed in advance via an e-mail message or in another suitable way so that they can easily acquaint themselves with the current version. If the Member does not agree with the change of the General Terms and Conditions or Fees of the Service, they are entitled to terminate the Membership Contract with a notice period of 1 month, which begins on the day following the day on which the notice was delivered to Tesco and Tesco will provide a partial refund to Member.
These Terms and Conditions and the relationships arising from them are governed by the law of the Slovak Republic.
The rights and obligations not regulated by this Chapter of Terms and Conditions are subject to the general terms and conditions of the Tesco Online Shopping (Grocery Home Shopping), which shall apply with the necessary modifications and the relevant provisions of legal regulations in force and effect in the territory of the Slovak Republic.All disputes arising from this Membership, if the parties fail to reach an amicable settlement, will be resolved by the competent courts of the Slovak Republic.
The Membership Contract is concluded in the Slovak language and these Terms and Conditions are essential part of it. Informative English translation is available for Customers.
If there is a difference between the Slovak and English versions of the TOC GTC or the contents of the Interfaces, the Slovak content shall prevail. Membership Contract is not archived by Tesco and is not accessible to the Member.
If a court of competent jurisdiction sets out the invalidity of certain provisions of the GTC, the invalidity of that provision shall not affect the other provisions of the Terms and Conditions, which will continue to remain in full force and effect.
If, in the event of single or repeated breaches of the Terms and Conditions, Tesco does not exercise its rights in relation to the breach of contract, it shall in no way be considered a waiver.
Tesco reserves its rights to terminate the Tesco Online Club without given reason. If Tesco completely terminates Tesco Online Club, the Member is entitled to a refund of an aliquot part of the paid Membership Fee, taking into account the number of months of provided Membership.
These TOC Terms and Conditions shall enter into force on 01.08.2023.
